The author examines the trial lawyers? view that protecting a doctor?s admission of error will prevent a patient from receiving compensation. That would be a bad thing ? there should be no tolerance for malpractice. But common sense suggests such rare cases would be far outweighed by the common good resulting from doctors feeling safe to speak openly after bad news happens.
